Terms of Service for TrainTrack

1. Acceptance of Terms

By downloading, accessing, or using the funfit.dev mobile application (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. These Terms constitute a legally binding agreement between you and funfit.dev ("we," "us," or "our").

2. Description of Service

The App provides an all-in-one platform for fitness tracking, including workout logging (running, gymnastics, weightlifting, functional training, etc.), participation in structured training programs, booking classes at affiliated gyms, performance tracking (including personal records - PRs), and community interaction features like leaderboards (collectively, the "Service").

3. User Accounts

To use certain features of the Service, you may need to register for an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate. You are responsible for safeguarding your account password and for any activities or actions under your account. You agree to notify us immediately of any unauthorized use of your account.

4. User Content

You are responsible for any data, text, information, graphics, photos, profiles, audio and video clips, links, workout logs, performance data, and other content (collectively, "User Content") that you submit, post, or display on or via the Service. You retain ownership of your User Content, but you grant us a worldwide, non-exclusive, royalty-free license to use, copy, reproduce, process, adapt, modify, publish, transmit, display, and distribute such User Content in connection with providing and promoting the Service.

You represent and warrant that you have all the rights, power, and authority necessary to grant the rights granted herein to any User Content that you submit.

5. Prohibited Conduct

You agree not to engage in any of the following prohibited activities:

• Using the Service for any illegal purpose or in violation of any local, state, national, or international law.
• Posting User Content that infringes the intellectual property rights, privacy rights, publicity rights, trade secret rights, or any other rights of any party.
• Posting User Content that is unlawful, obscene, defamatory, threatening, harassing, abusive, slanderous, hateful, or embarrassing to any other person or entity.
• Attempting to interfere with, compromise the system integrity or security, or decipher any transmissions to or from the servers running the Service.
• Using any robot, spider, crawler, scraper or other automated means or interface not provided by us to access the Service or to extract data.

6. Health and Safety Disclaimer

The Service offers health and fitness information and is designed for educational and entertainment purposes only. You should consult your physician or other health care professional before starting this or any other fitness program to determine if it is right for your needs.

Funfit.dev is not a licensed medical care provider and represents that it has no expertise in diagnosing, examining, or treating medical conditions of any kind. If you engage in this exercise or exercise program, you agree that you do so at your own risk and agree to release and discharge funfit.dev from any and all claims arising out of funfit.dev's negligence.

7. Intellectual Property

The Service and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of funfit.dev and its licensors. The Service is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of funfit.dev.

8. Third-Party Services (Gyms, Programs)

The App may allow you to interact with or book services from third-party gyms or access third-party training programs. We are not responsible for the services provided by these third parties. You agree that funfit.dev shall not be responsible or liable for any loss or damage incurred as the result of any such dealings.

9. Disclaimers

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. USE OF THE SERVICE IS AT YOUR OWN RISK. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL FUNFIT.DEV, ITS AFFILIATES, AGENTS, DIRECTORS, EMPLOYEES, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES ARISING OUT OF OR RELATING TO THE USE OF, OR INABILITY TO USE, THIS SERVICE.

11. Indemnification

You agree to defend, indemnify and hold harmless funfit.dev and its subsidiaries, agents, licensors, managers, and other affiliated companies, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses arising from your use of the Service, violation of these Terms, or violation of any third-party right.

12. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, for any reason whatsoever, including but not limited to a breach of the Terms. If you wish to terminate your account, you may simply discontinue using the Service.

13. Governing Law

These Terms shall be governed and construed in accordance with applicable laws, without regard to conflict of law provisions.

14. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms.
